Information about Consent for Commercial Communication



You hereby consent to the use and storing of your personal information you share with Etra Holding and all its subsidiaries, Makro İnşaat Tic. A.Ş. and all its subsidiaries and our group companies for the purposes of providing you with information regarding various services and product groups and various offers related to them, sending you special promotions, advertisements, sales information, surveys and similar electronic communication materials through text messages (SMS), visual or audio messages (MMS), electronic mails, mails, letters, telephone, call centers, automatic calls and mobile applications that allow for online communications such as WhatsApp as well as to the sharing of such information with our service provider for the same purposes. This information will be shared with third parties that we have a contract with, that share the same sensitive approach to data security as ours, and that comply with the relevant legislation, only if needed and to the extent necessary, for providing you with services in the best way possible, delivering any shipment without any issues and making sure that our messages are communicated to you on time through telephone, SMS and/or e-mail.

INFORMATION NOTE ON THE PROTECTION OF PERSONAL DATA



This Information Note covers the matters related to the processing and transfer of “Personal Data” of real persons under the Law No. 6698 on Protection of Personal Data (“the KVKK”). Under the Law No. 6698, any up-to-date information about you that you share with our company will be considered as ""Personal Data"".

The protection of your personal data is of paramount importance to us, and your personal data will be stored in line with the conditions stipulated by the relevant legislation, in the safest possible way and in accordance with the legislation, as long as legally required.

a) Data Controller and Representative Pursuant to the Law No. 6698 on the Protection of Personal Data (""the KVKK""), Makro İnşaat Tic. A.Ş. (hereinafter referred to as “Makro Construction”) acting as “Data Controller” shall be able to process your personal data within the scope described below.

b) Purposes of Personal Data Processing Your collected personal data may be processed for the purposes of fulfilling the obligations of our company and any real and legal person that has a business relationship with our company, sending information about updates, establishing and executing contracts to be entered into with you, reminding you of and fulfilling legal obligations, engaging in various advertising and marketing activities, carrying out and tracking financing, accounting and legal processes, follow-up procedures for your requests and complaints, following contract processes and/or legal requests, receiving your feedback through surveys and polls as part of the efforts to plan and carry out customer satisfaction activities, identifying the appropriate products, projects and services for you, customizing them in accordance with your needs and developing them, delivering an effective customer service, notifying you of any changes in legislation and internal policies of the company or providing you with any relevant notification, celebrating birthdays, including you in raffles and competitions, giving you gifts and carrying out other similar event, promotion and campaign activities that are in your favor, informing you through electronic mail, SMS and fax, notifying you about campaigns, sending you printed newsletters, magazines and articles about campaigns, identifying visitor profiles, evaluating requests, demands and complaints, carrying out the human resources policies of our company and respond to requests and inquiries from you, and as part of the personal data processing conditions and purposes specified in Articles 5 and 6 of Law No. 6698.

c) To Whom and for What Purpose the Processed Personal Data Can Be Transferred The below principles shall be complied with when your collected personal data are processed:

  • Being in conformity with the law and good faith;
  • Being accurate and if necessary, up to date;
  • Being processed for specified, explicit, and legitimate purposes;
  • Being relevant, limited and proportionate to the purposes for which the data are processed;
  • Being stored only for the time designated by relevant legislation or necessitated by the purpose for which the data are collected. Moreover, provided that personal data processing conditions and purposes set forth in Articles 8 and 9 of the KVKK are complied with and that necessary security measures are taken, the personal data may be shared with our direct/indirect domestic/foreign subsidiaries or affiliates, domestic/foreign/international public/private institutions and organizations, companies and other third parties or third party organizations that provide our company with services/support/consultancy or that our company cooperates with, our company’s subsidiaries, consultants, shareholders or other group companies that are our company’s solution partners, the Central Registry Agency and other authorized institutions and organizations, suppliers and subcontractors only for the purposes mentioned under clause (b) of this information note. MAKRO CONSTRUCTION may process and store your personal data in Turkey provided that necessary security measures are taken or abroad if the foreign country where the personal data will be transferred has an adequate level of protection; in case there is not an adequate level of protection, Makro Construction may process and store your personal data in servers or other electronic media abroad if Makro Construction and the data controllers in the relevant foreign country commit, in writing, to provide an adequate level of protection and the permission of the Board exists.

d) Collection Method of Your Personal Data and Legal Basis Our company may obtain your personal data through various channels (MAKRO CONSTRUCTION’s head office, branches, agencies, sales offices and other offices and physical spaces where you can contact the subcontractors and business partners of Makro Construction, call centers, websites, mobile applications and similar electronic platforms, social media and other public platforms, your participation in trainings, conferences and similar events organized by aforementioned parties, inquiries, other group companies, other contracted persons and organizations, physical or electronic media such as written materials, verbal communication, audio or video recordings, etc.). Your personal data may be collected, processed, transferred and stored within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK for the purposes specified in clauses (b) and (c) of this text. Your Personal Data are stored for a legally required period of time or for the period designated by relevant legislation, and in full compliance with the legislation.

e) Your Rights as a Data Subject If you, as data subjects, submit your requests regarding your rights to our Company using the methods set out below, our Company will respond to your request free of charge as soon as possible and within 30 days at the latest depending on the nature of your request. However, if a fee is determined by the Personal Data Protection Board, a fee determined by our Company will be charged. In this context, data subjects have the right to;

  • Learn whether or not her/his personal data have been processed;
  • Request information as to processing if her/his data have been processed;
  • Learn the purpose of processing of the personal data and whether data are used in accordance with their purpose;
  • Know the third parties in Turkey or abroad to whom personal data have been transferred;
  • Request rectification in case personal data are processed incompletely or inaccurately and request notification of any action taken to third parties to whom data is transferred,
  • Request the deletion or destruction of personal data in the event that the reasons necessitating their processing cease to exist, even though they are processed in accordance with the KVKK or relevant other laws, and request notification of the operations carried out accordingly to third parties to whom the personal data have been transferred,

  • Pursuant to paragraph 1 of Article 13 of the KVKK, you can submit your request in writing to our Company regarding the exercise of your rights mentioned above. You can submit your request specifying which of the rights listed in Article 11 of the KVKK you would like to exercise by filling out the form at www.makroinsaat.com, delivering a signed copy of the form that is addressed to MAKRO CONSTRUCTION Customer Relations Department and supplemented with documents identifying who you are to “Atakent Mh. 4. Cd. No:28 Halkalı-Küçükçekmece/İSTANBUL” by hand or sending it through a notary public.
  • Our company reserves the right to make changes in this information note as required by the changes in the KVKK and the methods to be determined by the Personal Data Protection Board.
